I. Purpose
The purpose of this Interim Annual and Sick Leave Policy (“Policy”) is to provide a description of the annual and sick leave available to employees of Anne Arundel Community (“College”) as required by law and provided by the terms and conditions of their employment.
II. Scope and Applicability
A. This Policy applies to all Eligible Employees of the College community, including faculty, staff, and temporary employees.
B. To the extent that the College Manual, Procedures or Guidelines conflict with this Policy, this Policy supersedes the College Manual and such other Procedures or Guidelines.
C. Where a collective bargaining agreement (CBA) applies, the terms of the CBA shall govern to the extent they conflict with this Policy.
III. Definitions
A. ASO Employee means a member of the Administrative Staff Organization employed on a Full or Part-Time basis, Vice Presidents and employees of the General Counsel’s office are not categorized as ASO employees.
B. Compensatory Leave is paid leave which is earned and accrued by an Eligible Employee in lieu of immediate cash payment for hours worked in excess of their regularly scheduled working hours, with the prior approval of the Supervisor.
C. Eligible Employee means an employee who is described in the Interim Annual Leave Procedure as being eligible for a Leave Category.
D. Faculty includes Twelve-Month Faculty, Ten-Month Faculty and Part-Time Faculty.
E. Leave Category means a form of Leave that is available to Eligible Employees as defined in Leave Procedures.
F. Leave Procedure means eligibility requirements, Guidelines, directions, or processes to be followed to implement this Leave Policy for Annual Leave or Sick Leave.
G. Leave means an authorized absence from work.
H. Part-Time Faculty means those who are employed to teach at the College on a course-by-course basis as demand requires, with the arrangement to be made by written contract.
I. PSSO Employee means an Employee who is a member of the Professional and Support Staff Organization.
J. Supervisor is the College employee to whom an Employee directly reports.
K. Ten-Month Faculty means Faculty who receive an appointment from the College that is ten (10) months in duration.
L. Temporary Employees means any employee employed on a temporary, hourly basis.
M. Twelve-Month Faculty means Faculty who receive an appointment from the College that is twelve (12) months in duration, and Administrators with Faculty Rank.
IV. Leave Categories
Following is a listing of Leave Categories. For each Leave Category described below, a Leave Procedure has been developed to implement the particular form of Leave, describing the rate of Leave accrual, eligibility for Leave, and regulations governing usage of Leave.
A. Sick Leave
The College provides paid Sick Leave to Eligible Employees when they are absent from work to care for or treat the Employee’s illness, injury or medical condition, to obtain preventative medical care for the Employee or the Employee’s family member, to care for a family member with an illness, injury or condition; for maternity or paternity leave, or where the absence from work is necessary due to domestic violence, sexual assault or stalking committed against the Employee or the Employee’s family member, as detailed in the Interim Sick Leave Procedure.
B. Annual Leave
The College provides paid Annual Leave to Eligible Employees for the purpose of taking regularly scheduled work time off for any reason. Such leave accrues at various rates depending on employment category and/or length of service, as described in the Interim Annual Leave Procedure.
V. Exceptions
Exceptions to the above Policy shall be permitted only when specifically approved by the Executive Director of Human Resources.
